The Dolan Law Firm is pleased to announce that The Commerce Insurance Company of Massachusetts recently agreed to pay $250,000 to settle a client’s case even though the defendant only had a $100,000 liability insurance policy.
A young active duty military family came to the Dolan Law Firm because they were unfairly only being offered $12,000 for the serious low back injuries the wife had suffered in a rear end car accident. The couple had become pregnant three months after the collision, so the insurance company tried to claim that the wife’s low back pain after conception was caused by the pregnancy.
The couple had been so harangued by the insurance company, that they had only asked for $ 60,000.00 to resolve all of their claims before they came to the Dolan Law Firm. The Dolan Law Firm understood the true value of the case. We were disgusted that such good people, who dedicate their lives to serving this Country, were being treated so poorly by a heartless insurance company.
The Dolan Law Firm went to work. We gave the insurance company the chance to do the right thing, but it refused. We were pleased that the company maintained its ridiculous positions, because it was putting itself in a position of having to pay more than the limits on its insured’s policy.
We hired the necessary experts to prove that the wife’s injuries were solely caused by the automobile collision. We also attacked the insurance company’s expert’s opinions.
Facing the threat of “bad faith” litigation, Commerce Insurance Company agreed to pay $250,000, which was $ 150,000 more than the $ 100,000 policy limits and more than 20 times the offer it had given the client before the Dolan Law Firm became involved. As a result, our client finally received fair compensation for her serious injuries.
