You Are No Less Equal

The California Fair Employment and Housing Act (FEHA) states that transgender individuals are entitled to civil rights protection in housing and employment. Transgender persons now have legal remedies to fight discrimination and harassment that did not exist before.

But those legal protections are only effective if you seek enforcement. At The Dolan Law Firm, our California transgender rights lawyers fight for the rights and dignity of transgender people. As attorneys, advocates, and activists, we help put the ‘fair’ back in ‘fair fight.’

If you have been plagued by harassment in the workplace, have been treated differently in public accommodations, have been denied housing, or been discriminated against by your health insurer, you may have a cause for legal action.

Don’t put up with unfair and illegal conduct. Contact a San Francisco transgender rights attorney today to talk about the situation.

California Transgender Rights

Employment rights :
You have a right to be free from workplace discrimination in hiring decisions, treatment in the workplace, and termination decisions. Your employer cannot fire you because you take medical leave for transition surgery or because you are transgender. You have a right to be free from harassment in the workplace because of your gender identity. You have a right to reasonable accommodations, such as access to appropriate restroom facilities.

If your employer has terminated your employment or changed the terms and conditions of your employment because you came out as transgender or began to transition, you may have a claim under FEHA for damages.

Housing Rights :
Neither a landlord nor a real estate seller, agent or broker can legally discriminate against you for:

  • Changing your name
  • Beginning to dress in a manner that conforms to your gender identity
  • Taking hormones that are appropriate to your gender identity
  • Undergoing a sex-change operation

Equal access to commercial establishments
: As with sexual orientation, your right to service from businesses is also protected.

Healthcare and insurance: The Insurance Gender Non-Discrimination Bill protects transgender persons from discrimination by health insurers and healthcare providers. In addition, if you are a city of San Francisco employee, you may have the right to have your sex-change operation paid for by your health insurance.
