Does the First Amendment Protect Your Right To Protest At A Political Rally?

US Supreme Court with Flag_horizontal small crop.jpg

Matt G. from San Francisco asks: “I’ve been following the 2016 Presidential election process, both parties, all candidates. I have heard candidates say that protestors at their rallies are trampling on the First Amendment free speech rights of their supporters who also attend those rallies. Doesn’t the First Amendment also protect an individual’s right to protest?”

The short answer is yes, it does. Recently people have misinterpreted the right to express themselves however they want to politically as the right to do so without being subjected to anyone who disagrees with them or holds differing opinions. The right to free speech is sacred in this country. But so is the right to protest, one of the significant motivations behind having First Amendment protections in the first place.

The Pay Gap And Gender Discrimination

The battle against discrimination in employment is fought on many fronts. Discrimination is an ugly reality in the employment world. People are routinely excluded from jobs, promotions and fair pay. They are subjected to hostile work environments and denied benefits guaranteed by California and federal laws. One of the oldest forms of discrimination is still a persistent problem: gender discrimination.

How impact speed changes the risks in an accident

Pedestrians crossing

When looking at a pedestrian accidents, one of the biggest factors that contributes to the outcome—and the likelihood of either serious injuries or the death of the pedestrian—is impact speed. Studies have been carried out for years to find out how the speed of the vehicle changes the situation and what can be done to keep people safe.

One study found that the risk of a severe injury hit 10 percent if a car was traveling at just 16 miles per hour when it hit a person. This is well under most speed limits, even in residential areas where people are often present.

How California Prop 213 Harms Consumers

Damaged car

This week’s question comes from Zach L from the Castro: “I was recently hit by a car that ran a red light on Mission Street at the intersection of 19th St. I just bought the car that I was driving two days earlier and I had yet to purchase insurance. I broke my arm. The police found that the other guy was a fault and although I didn’t do anything wrong I’ve been told that I can’t recover for my pain and suffering because I didn’t have insurance on the car at the time that I was hit. Is this true? This doesn’t seem fair.”

Zach, I’m sorry to hear about your collision. Although you did nothing wrong to cause your injuries, I am sad to say that this may indeed be true.

Can You Say “No” To A Police Officer Who Demands You Unlock Your Mobile Phone?

Iphone Screen Shot.jpg

This week’s question comes from Joel F. in Berkeley who asks: “I read your article last week on Apple’s objection to the FBI demanding that they build a back door to the IPhone operating system to bypass the encryption on the phone of the San Bernardino shooter. What rights do I have over my IPhone if a cop demands that I unlock my phone and show it to him?”

Joel, your question is very timely and shows how the interpretation of our constitutional rights to privacy must constantly evolve to keep up with technology.

Do riders get injured or killed more as they age?

Motorcyclists have never had it easy on the roads; drivers who don’t see them can hit them and cause serious or fatal injuries. The motorcycles themselves don’t offer protection against being hit, and the weight of a vehicle against a human body can be devastating. Even if the motorcyclist is thrown, hitting the ground at a high speed can result in broken bones, traumatic brain injuries and other injuries that need to be covered by the negligent driver’s insurance coverage.
